The dispute over the building permit continues to come to a head: According to a judgment of the 5th Chamber of the Neustadt administrative court, the lawsuit against the building permit for the renovation and expansion of the Brunnenhalle was dismissed. This judgment, which was delivered on August 1, 2023, finds that the building permit does not violate residents' rights. The plaintiff, an owner of two plots near the Brunnenhalle, had argued that the approval for an "event location" was inappropriate and the specific rights of the residents were disregarded.

The district administration of Bad Dürkheim gave approval on April 14, 2022 for the renovation and expansion of the Brunnenhalle, which also includes the cultivation of a tourist information with office unit and gastronomy after demolishing a northwest extension. The plaintiff had brought an action according to an unsuccessful objection procedure in September 2022 and claimed that the approval was "tailored" for inappropriate use, but the lawsuit was nevertheless rejected because the "Kurgebiet" development plan does not grant a third -party protection for owners outside the planning area.

The decision of the court could not have been the last word, since the plaintiff has the opportunity to submit an application for admission of the appeal within one month of delivery at the Rhineland-Palatinate Higher Administrative Court.
