Gelsenkirchen: Court forces city to set up the disabled parking lot!
Gelsenkirchen. A 77-year-old man has won a remarkable victory before the administrative court! Hans K. fought against the city of Gelsenkirchen, which had refused a handicapped parking lot in front of his apartment on Bulmker Strasse. Despite an absolute ban on holding in the entrance to the garage, the court decided: The city must now set up a parking space for it!
The lengthy legal dispute was worth it for Hans K. The city had only offered him to park his vehicle in parallel to the road, but this was not the case of the existing parking ban. But the judges disagreed: they emphasized that the man has a legal right to a special parking space due to his extraordinary walking disability. The parking lot must now be officially signposted and can no longer be tolerated by the city.
The special circumstances of the case
The court made it clear that the plaintiff's severe disability was crucial for finding the judgment. Although Hans K. has a garage, he cannot reach it due to the steep access ramp and the tight stairs. This means that he is dependent on the parking lot to be able to park his car safely. The city of Gelsenkirchen now has the task of marking the handicapped parking lot either directly on the garage entrance or next to the curb.
The court's decision shows that the plaintiff's interest in a practical parking is above the general interest in a barrier -low street crossing. A clear victory for the rights of people with disabilities in Gelsenkirchen!
