Brietlingen. A dramatic legal dispute at the sports field in Brietlingen has now taken a turn! The district of Lüneburg ordered in June this year that the owner had to remove the inadmissible buildings. Despite his objection to the Lüneburg Administrative Court, the second chamber of the court confirmed the district's decision in an urgent procedure. The owner has to clear the approximately two hectares of land - a clear victory for the building supervision!

But not everything is lost! A caravan with a Bulgarian license plate may remain for the time being, as it is unclear who it belongs. The court found that the district should have considered other possible owners. "In this respect, the decision cannot be enforced for the time being," said the Chamber's decision. Nevertheless, the court followed the arguments of the district that the containers and caravans are considered to be structural systems that are inadmissible on this property outdoors.

Inadmissible structural systems

The owner had set up the containers to realize different business ideas, including the cultivation of earth, a dog park and even mushroom breeding! But the court was skeptical and could not convince him of the profitability of its vague plans. It was found that there were no agricultural or horticultural activities, which weakened the man's argument. Even the Lower Saxony Chamber of Agriculture sees no basis for agricultural activities.

Legal dispute goes on

The decision of the Administrative Court is not yet final! Within the next two weeks, the participants have the opportunity to appeal to the Lower Saxony Higher Administrative Court. The outcome of this legal dispute remains exciting!
