Freut sich auf den Start des Cannabis-Clubs „Exotic Kingdom CSC Fulda“: Der Gründer Willi Kappes in der Anbauhalle eines Partners in der Schweiz. © privat
Cannabis-Clubs können seit dem 1. Juli Lizenzen beantragen. In Fulda steht nun ein Verein nach monatelangen Vorbereitungen in den Startlöchern. Dort soll bald Cannabis angebaut und unter Mitgliedern verteilt werden können. Doch die bürokratischen Hürden sind hoch.
Fulda – „Wir fiebern dem Start entgegen“, sagt Willi Kappes, Gründer des „Exotic Kingdom CSC Fulda“. Der vor drei Jahren gegründete Cannabis Social Club steht nach monatelangen Vorbereitungen kurz davor, seine Lizenz zu erhalten. Ein Termin mit der Polizei und der zuständigen Behörde als letzter Schritt soll in den kommenden Wochen stattfinden.
„Dabei werden unsere Konzepte, die Anbauhelle und die Ausgabestelle geprüft und abgenommen“, erklärt Kappes. Der 26-Jährige blickt zuversichtlich voraus: „Derzeit absolvieren wir noch Kurse zum Thema Suchtprävention, danach sollte die Genehmigung erfolgen.“
Fuldaer Cannabis-Club vor dem Start: Derzeit rund 100 Mitglieder
Liegt diese vor, können nach den Bestimmungen des zum 1. April in Kraft getretenen Cannabisgesetzes Hanfpflanzen für den nicht-kommerziellen Zweck gemeinschaftlich angebaut und das produzierte Cannabis zum eigenen Gebrauch an volljährige Mitglieder weitergeben werden. Erlaubt sind höchstens 25 Gramm pro Tag und höchstens 50 Gramm Cannabis pro Monat je Mitglied. Für Heranwachsende zwischen 18 und 21 Jahren gelten geringere Mengen.
Kappes und sein Team des „Exotic Kingdoms“ bereiten sich schon seit der Gründung Ende 2022 auf diesen Tag vor: „Wir befinden uns seit fast zwei Jahren in den Vorbereitungen. Uns war klar, dass es irgendwann zur Legalisierung kommen wird. Wir sind froh darüber, dass die Politik im April diesen Schritt gegangen ist.“
Schon vor dem Start zählt der Verein rund 100 Mitglieder. „Wir waren schon einmal fast 300 Leute, aber ein paar sind wieder abgesprungen – aus verschiedensten Gründen“, sagt Kappes. Auch finanzielle Gründe spielten eine Rolle, sagt er. Denn wer Mitglied werden will, zahlt eine einmalige Aufnahmegebühr von 200 Euro und danach monatlich 25 Euro. Vor allem zum Start werde Kapital benötigt. Denn alleine ein dreitägiger Präventionskurs koste 600 Euro, der Antrag selbst 3500 Euro.
Alter der Mitglieder „zwischen 35 und 50 Jahren“
Eine 350 Quadratmeter große Halle für den Anbau hat der Verein bereits gefunden: „Diese wird sich in Bad Brückenau befinden“, teilt Kappes mit. „Der Hauptsitz und die erste Abgabestelle befinden sich aber natürlich weiter in Fulda. Doch auch in Bad Brückenau (Unterfranken) soll es neben der Anbau-Halle eine Abgabestelle geben, „um unsere Reichweite zu erhöhen und noch mehr Menschen zu erreichen“.
Kernziel des Engagements von Kappes mit dem Cannabis-Club: „Wir wollen den Schwarzmarkt effektiv zurückdrängen und den Jugendschutz stärken“, erklärt Kappes.
Bayerische Behörden übernehmen Lizenzantrag von Fuldaer Anbauvereinigung
Mit Sitz in Fulda ist für die Prüfung des Lizenzantrags eigentlich das Land Hessen und das Regierungspräsidiums Darmstadt zuständig. Dort sind bisher 16 Anträge von hessischen Cannabis Social Clubs eingegangen. Doch im Fall des „Exotic Kingdom CSC Fulda“ prüft die bayerische Landesbehörde – das Bayerisches Landesamt für Gesundheit und Lebensmittelsicherheit in Erlangen – den Antrag.
Club-Gründer Willi Kappes erklärt den Schritt wie folgt: „Wir wollten keine Zeit verlieren. In Hessen war es damals noch nicht möglich, einen Antrag zu stellen.“ Auf Anfrage unserer Zeitung heißt es aus der Pressestelle des RP, das mittlerweile innerhalb des RP Darmstadt eine Projektgruppe gegründet wurde, „die dafür sorgen wird, dass Anträge für die Zulassung nicht-kommerzieller Anbauvereinigungen innerhalb der gesetzlichen Vorgaben bearbeitet werden“.
Eine Entscheidung über den Antrag auf Erlaubnis solle innerhalb von drei Monaten erfolgen. Während in Bayern bereits Präventionsschulungen stattfinden, laufen in Hessen aktuell die Abstimmungen, wer Schulungen für die Präventionsbeauftragten anbieten kann.
Zum speziellen Fall des „Exotic Kingdom“ teilt das RP mit: „Da die Anbauvereinigung ihren Sitz in Fulda hat, ist das RP Darmstadt für die Erlaubniserteilung grundsätzlich zuständig. Allerdings hat die Anbauvereinigung einen zusätzlichen Sitz in Bayern. Daher hat die Erlaubnisbehörde in Bayern nach Rücksprache mit dem Antragsteller um Übernahme der Bearbeitung des Antrags gebeten. Das RP Darmstadt hat sich mit der Übernahme einverstanden erklärt.“
Wie viel Cannabis künftig in der Halle des Cannabis Social Clubs angebaut wird, ist noch unklar. Das hänge von der Nachfrage der Mitglieder ab. Der Annahme, dass vor allem junge Menschen Joints rauchen wollen und Mitglied in Cannabis-Clubs werden, widerspricht Kappes: „Das Durchschnittsalter unserer Mitglieder liegt zwischen 35 und 50 Jahren. Junge Leute melden sich bisher kaum an.“

Cannabis-Clubs dürfen bundesweit seit dem 1. Juli eine Lizenz bei der zuständigen Behörde beantragen. Die Zeit, in der die Behörde den Antrag prüft, haben die Fuldaer genutzt, um sämtliche Konzepte vorzubereiten: „Wir haben ein Vernichtungskonzept, ein Hygienekonzept, ein umfassendes Transportkonzept sowie Konzepte für Fluchtwege und Brandschutz ausgearbeitet“, so Kappes. Derzeit werde an weiteren Konzepten gearbeitet.
Im Fokus des Clubs liege zudem der Jugendschutz und die Suchtprävention. Im Rahmen seiner Präventionsarbeit wolle der Verein „Exotic Kingdom“ deshalb Workshops anbieten und an Schulen über die Gefahren des Cannabis-Konsums für Jugendliche in der Entwicklungsphase aufklären. Für seine Mitglieder stelle der Club überdies eine „von Experten geführte“ Präventionsstelle zur Verfügung.
So sollen Cannabis Social Clubs funktionieren
Cannabis Social Clubs (CSC) sind Vereine für den gemeinschaftlichen Anbau von Hanfpflanzen. Ihre Mitglieder unterstützen einander beim Eigenanbau von Cannabis. Die produzierten Blüten werden vereinsintern weiterverarbeitet und für den eigenen Gebrauch verwendet. Die Cannabis-Clubs dürfen pro Monat 50 Gramm an über 21-Jährige abgeben. 30 Gramm pro Monat dürfen an Erwachsene bis 21 Jahren abgegeben werden. Die Vereine dürfen nicht mehr als 500 Mitglieder zählen, an die Cannabis weitergegeben wird.
Das Cannabis, das über CSC vertrieben wird, muss zudem in einem Labor auf Schadstoffe getestet werden. Ein Beipackzettel muss über Inhaltsstoffe aufklären. Im Gesetz verankert ist zudem, wie die Cannabis Social Clubs mit dem Thema Suchtprävention umgehen sollen. Die Clubs müssen einen Präventionsbeauftragen benennen und ein Jugendschutzkonzept vorlegen. Werbung ist für die Clubs gesetzlich verboten und es sind Abstandsregeln zu Kindergärten, Schulen, Spielplätzen und Jugendeinrichtungen einzuhalten.
Cannabis-Clubs werben mit den Vorteilen, dass Mitglieder hier die Möglichkeit haben, legale, saubere und getestete Cannabisprodukte zu konsumieren.
Mit den „Broccoli Buddies“ steht in Fulda eine zweite Anbauvereinigung vor dem Start. Ende März gehörten dem Cannabis-Club bereits rund 350 Mitglieder an. Die Vorsitzende Elena Fischer wollte auf Anfrage derzeit allerdings keine Angaben zum Stand eines möglichen Lizenzverfahrens machen.
