In a shocking turn of the events, a 53-year-old gardener from Hamburg was convicted of setting a Christmas tree on the grounds of a daycare center in a nightly campaign. The gardener, managing director of a garden plant provider, thought that he would be happy for the children, but the daycare center was anything but enthusiastic. The judge of the district court made it clear: "There was a goal. It is not desired that everyone simply enters on this area." The punishment? A juicy fine of 3,000 euros!

The daycare center in the Hamburg district of Lokstedt had previously decided not to set up a Christmas tree to respect the children's religious freedom. Instead, there were other festive decorations such as advent calendars and gnomes. The gardener was aware of the decision, but that did not stop him from secretly positioning the tree and gifts. The daycare reacted promptly and filed a complaint for trespassing.

The case caused excitement when the gardener's lawyer said that his client had only done a good deed. He criticized that the gardener was in court and argued that the gate was not complete and there was no sign that banned access. Supporters of the gardener published in front of the court in T-shirts with the inscription "No tree is illegal", while a person in the fir tree costume attracted additional attention. The gardener himself appeared in gardener clothing and was unimpressed by the legal discussion.
