Murder in Wasserburg: Was the perpetrator really incapable of guilt?

Wasserburg-Gabersee, Deutschland - A shocking murder case shakes Wasserburg! On April 8, 2024, the popular senior physician Rainer Gerth was brutally stabbed. The perpetrator, Dominik S., had forged a devilish plan for months to kill the doctor. Driven by delusions, he was convinced that people were poisoned in the KBO-in-Salzach clinic and cruel experiments were carried out on children. His goal: Rainer Gerth, who represented the embodiment of evil for him.

The day on the said day, S. was waiting for Gerth with a kitchen knife that he bought in Traunreut two weeks earlier. At 6 p.m. he struck and stabbed the unsuspecting doctor into his chest and arm. The attack was so brutal that the knife broke through a rib and entered the heart. Gerth managed to drag himself 61 meters towards his office before collapsing. Despite immediate rescue measures, any help came too late. The shock sits deeply: a father, brother and partner was murdered before the eyes of his colleagues and patients!

The last day of the trial: inability to guilt in focus

On November 19, 2024, the last day of the trial took place before the Traunstein Regional Court. The central question: was Dominik S. guilty at the time of the crime? While the public prosecutor's office assumed a mental illness, the co-lawsuit called for a more precise examination of its ability to inspect and control. Lawyer Jörg Zürner emphasized that the mere diagnosis of paranoid schizophrenia does not automatically lead to inability to guilt. Dominik S. had planned the crime for months and meticulously prepared for the murder.

In his last words, S. asked for accommodation in a psychiatric clinic and apologized to the relatives of Gerth. But the pain remains immeasurable for the family. Rainer Gerth's daughter explained: "You killed our dad and thereby torn the ground under our feet." The presiding judge finally followed the application of the public prosecutor and ordered Dominik S. to accommodate Dominik S. in a psychiatric clinic, which should finally clarify the question of his inability to blame.
