The road building authority argues that continuous speed reduction at 30 km/h is inadmissible and instead suggests passive noise protection measures such as soundproof windows. Herrmann is outraged: "I think it is an outrage how it is argued here. The need for protection of people from noise is put behind the law of the driver."

The decision of the authority is also sharply criticized by Mayor Florian Hoffmann (LWG) from Utting. He cannot understand why the number of residents concerned is considered too low. The municipalities got legal support from the Munich law firm AVR, which was already successful in similar cases. Hoffmann is combative: "Our lawyer clearly assumes the feasibility of the action plan."
