The Augsburg Regional Court declared the re -admission of the convicted murder, Benedikt T., to be admissible in two crucial points. A court spokesman confirmed the exciting news.
The judges justify their decision with a new testimony that was not discussed in the main hearing at the Munich I district court. At the time, this witness had rely on her right to refuse to testify. In addition, there are now two fresh expert reports that could possibly represent new evidence. "In its decision, the court did not rule out a possible impact on the guilty verdict," said the judges.
The case is newly illuminated
However, whether the case is actually reopened remains uncertain. First of all, the non-public probation procedure must take place in which witnesses and experts are listened to in order to examine the reasons for resuming the procedure. It is only at the end of this procedure that it is decided whether the case will come back to court.
the nephew of the millionaire, who spent almost 17 years in prison, was released last year. The wealthy widow was brutally killed in her apartment in May 2006. Shortly afterwards, her nephew was arrested and convicted in 2008. The then 33-year-old always asserted his innocence and sees himself as a victim of the judiciary. This is already his third attempt to resume the procedure, and the case continues to cause a stir because family and friends are tirelessly fighting for his innocence.
