City of Schömberg loses urgent application: 135,000 euros of waste fees to be paid!
Schömberg, Deutschland - an outcry in Schömberg: The city has to pay 135,000 euros in waste fees after a lawsuit against the decision of the District Office in Zollernalbkreis has failed! In a dramatic urgent procedure, the Sigmaringen Administrative Court decided on October 23 that the city was initially asked to checkout. The reason? Contaminated soil material that was discovered in the construction of a roundabout in the "Grund" development area.
The shock is deep, because the city had believed that the district had to be responsible for the harmful contaminated sites. However, the court made it clear that the city, as the client who had contractually agreed with the district, was also asked to pay for the construction work. The Baden-Württemberg Local Tax Act, which regulates the obligation to pay fees, is cited in an exemplary manner. But how could this dilemma come?
Who is to blame for the catastrophe?
The bouquet of allegations unfolds: the construction work began in May 2023, and old material was excavated, which apparently comes from an old road. The city surprised itself, because the ground had not been checked at this depth! The district office sets the fee - however, the city sees itself as the victim of a system in which the district is responsible for the old contamination. According to the court, however, the city was responsible for the excavation material. Because with the shovel, the material becomes a waste immediately.
The decision is not yet final! Schömberg now has the opportunity to make a calling. Within two weeks, those responsible must open the court in order to continue to insist on their right. The expectations are high, but the judgment is already a surprise in the books.
