Process chaos in Stuttgart: Schöffe reads whatsapp - negotiation new!

Before the Stuttgart district court, the trial of three men who are said to be involved in a series of violence in the Stuttgart area took an unexpected turn. The process must be re-rolled up due to an incident in which a lay judge read a WhatsApp message during a testimony. This led to an application for all accused at the rejection of the lay judge due to possible bias.

However, the application for rejection was accepted by the criminal chamber of the Stuttgart Regional Court. A spokesman for the court announced that the accused and their lawyers believe that the lay judge could already have committed to a specific result. According to the provisions of the Code of Criminal Procedure

New start of the process and allegations

The new process begins for January 7, 2025, whereby all previous negotiations, including the witness interrogations, must be carried out again. The two young men, a 21-year-old and a 22-year-old, are accused of attempted murder because in March 2023 they are said to have shot a 34-year-old Turk in the Zuffenhausen district.

A 21-year-old Turkish citizen is charged with the trial of punishment because he is accused of disposed of the illegal weapon that was used in the crime after the incident. The shots are part of a series of violence that was committed between rival gangs in the Stuttgart region. The alleged perpetrators should belong to a group from the Esslingen area, while the victim is identified as a leader of the rival group from Zuffenhausen.
